Terms of Service

These Terms of Service ("Terms") govern access to and use of the ClawdCallplatform and related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
Company and service details
1. About the Service
ClawdCall is a software platform that enables users to configure agents, workflows, or integrations capable of placing and managing voice calls.
ClawdCall is designed as a personal calling assistant that enables users to initiate automated calls to themselves or individuals who reasonably expect to receive the call, such as for reminders, alerts, or information relay.
The Service is not intended for bulk outreach, telemarketing, sales campaigns, political messaging, or automated contact lists.
The Service may include:
- outbound call initiation
- AI-powered voice interactions
- speech-to-text and text-to-speech processing
- call transcripts and summaries
- call metadata and analytics
- workflow integrations
ClawdCall is provided by Chirpy AU Pty Ltd ("Company", "we", "us", or "our").
The Service may rely on third-party providers including telephony carriers, speech services, AI providers, cloud infrastructure providers, and payment processors.
The Company is not a telecommunications carrier.
2. Eligibility
You must:
- be at least 18 years old
- have legal authority to enter into these Terms
- comply with all applicable laws and regulations
3. Account Registration
To use the Service, you must create an account.
You agree to:
- provide accurate information
- keep login credentials secure
- notify us of unauthorized use
- accept responsibility for account activity
4. Acceptable Use and Prohibited Communications
Users must only place calls to:
- the account holder
- internal team members
- recipients who have consented to or reasonably expect the call
Users are responsible for ensuring that recipients reasonably expect to receive calls initiated through the Service.
To prevent abuse, ClawdCall limits the number of unique call destinations that may be contacted by an account within a rolling 24-hour period. Additional safeguards may be applied to restrict excessive or suspicious calling activity.
Users must not use the Service for:
- conduct telemarketing or bulk calling
- send unsolicited robocalls
- harass, threaten, or impersonate individuals
- conduct scams or fraudulent activity
- place calls in violation of applicable communications laws
ClawdCall reserves the right to suspend or terminate accounts engaged in prohibited communications.
The Service must not be used for high-volume outbound communications without appropriate regulatory compliance.
5. Automated Communications Compliance
Customers who use the Service to place outbound calls are solely responsible for complying with all applicable telecommunications, marketing, and consumer protection laws.
This includes but is not limited to:
- Telephone Consumer Protection Act (TCPA)
- Do Not Call regulations
- Anti-spam laws
- Robocall restrictions
- similar regulations in other jurisdictions
Customers must ensure that:
- they have obtained all required consent prior to initiating automated calls
- calls comply with all applicable opt-out and identification requirements
- recipients may request to stop receiving calls
ClawdCall does not monitor or control the legality of customer call campaigns and assumes no responsibility for violations of applicable calling laws.
6. Use of Artificial Intelligence
Responses generated during calls may be produced using automated systems, including artificial intelligence. Such outputs may contain errors or inaccuracies.
ClawdCall provides functionality that may incorporate artificial intelligence, machine learning models, and automated decision systems to generate responses, summaries, or actions during calls.
You acknowledge and agree that:
- AI-generated responses may be incomplete, inaccurate, or inappropriate in certain contexts.
- The Service does not guarantee correctness of outputs generated by AI systems.
- You are solely responsible for reviewing, validating, and supervising outputs generated by automated agents before relying on them in any critical context.
ClawdCall shall not be liable for decisions made or actions taken based on AI-generated outputs.
7. Recording and Monitoring of Calls
The Service may enable recording, transcription, or monitoring of telephone calls.
Customers are responsible for ensuring that:
- all participants are properly informed that calls may be recorded or monitored
- any legally required consent is obtained prior to recording
- such recording complies with all applicable laws in the jurisdictions where calls are placed or received
ClawdCall is not responsible for determining whether consent is required for a particular call.
8. Abuse Prevention and Carrier Compliance
The Company may monitor usage patterns and may restrict or suspend accounts that generate complaints, abuse signals, or regulatory risk.
To protect telecommunications infrastructure and service providers, the Company may:
- limit call destinations
- enforce rate limits
- block certain call categories
- suspend accounts pending investigation
These actions may be taken without prior notice.
9. Service Limits
The Company may impose limits including:
- call concurrency limits
- daily recipient limits
- geographic restrictions
- spending caps
These limits may change without notice.
10. Billing
The Service may be billed using subscriptions, prepaid credits, or usage-based pricing in AUD.
Fees are non-refundable except where required by law.
11. Third-Party Services
The Service relies on third-party infrastructure providers including telecommunications carriers, AI model providers, speech processing services, and cloud infrastructure providers.
Service performance may depend on the availability and reliability of these third-party services.
ClawdCall is not responsible for service interruptions, delays, or failures caused by third-party providers.
12. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, the Company makes no warranties, express or implied, including but not limited to warranties of:
- merchantability
- fitness for a particular purpose
- non-infringement
- uninterrupted or error-free operation
The Company does not warrant that:
- calls will always be successfully completed
- call quality will meet any particular standard
- third-party integrations will function without interruption
- the Service will be available at all times
Nothing in these Terms excludes any consumer guarantees that cannot be excluded under applicable law.
13. Limitation of Liability
ClawdCall is not responsible for the content of calls or communications initiated by users through the Service.
To the maximum extent permitted by law, total liability of the Company arising out of or relating to the Service, whether in contract, tort (including negligence), statute, or otherwise, will not exceed the total amount paid by the user to the Company for the Service during the twelve (12) months preceding the event giving rise to the claim.
In no event will the Company be liable for any:
- indirect loss
- consequential loss
- loss of profits
- loss of business opportunity
- loss of data
- reputational damage
- regulatory penalties incurred by the user
This limitation applies even if the Company has been advised of the possibility of damages.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable consumer protection laws.
14. Customer Responsibility
Customers are responsible for:
- the content of automated calls generated through the Service
- ensuring compliance with applicable laws and regulations
- the actions of any automated agents configured by them
Customers agree to indemnify and hold harmless ClawdCall and its affiliates from any claims, damages, penalties, or liabilities arising from misuse of the Service or violations of applicable laws.
15. Limitation of Liability for Automated Systems
To the fullest extent permitted by law, ClawdCall shall not be liable for:
- incorrect AI-generated responses
- misunderstandings caused by speech recognition errors
- decisions made by automated agents
- actions taken by call recipients based on automated conversations
16. Vendor Dependencies
Certain functionality of the Service depends on third-party providers of artificial intelligence, speech processing, telecommunications, and hosting infrastructure.
The Company does not guarantee continued availability of any specific provider or integration and may change providers at any time.
The Company is not responsible for loss or disruption caused by actions, outages, or policy changes of such providers.
17. Indemnification
Users agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and affiliates from claims, damages, liabilities, fines, penalties, or expenses (including legal fees) arising from:
- the user's violation of applicable telecommunications or telemarketing laws
- unlawful or abusive calling practices
- failure to obtain required consent for calls or recordings
- misleading or unlawful content communicated through calls
- regulatory enforcement actions related to the user's use of the Service
18. Suspension
We may suspend or terminate accounts if we reasonably believe the Service is being used unlawfully or abusively.
19. Governing Law
These Terms are governed by the laws of Victoria, Australia.
